General Purpose

This role is a senior leadership position responsible for overseeing all aspects of workplace investigations and managing associated litigation risks for an organization, specifically related to the employee life cycle in human resources. The ideal candidate possesses a deep understanding of employment law and HR practices, coupled with proven experience in conducting and managing complex investigations and pre-litigation matters.

Key responsibilities

  • Lead and manage HR workplace investigations team.
  • Develop and implement investigative protocols, conduct and oversee sensitive investigations (e.g., harassment, discrimination, retaliation), and ensure fairness, thoroughness, and compliance with company policies and legal requirements.
  • Advise and support PACS and HR Business Partners on employment-law related matters, including hiring, performance management, terminations, discrimination, harassment, accommodations, leaves of absence, wage and hour issues, incentive compensation, benefits (including plan design, implementation, administration and communications), and employee investigations.
  • Proactively identify and assess potential risks related to workplace conduct and employment practices, implementing preventative measures and offering guidance to mitigate potential liabilities.
  • Maintain subject matter expertise and proactively monitor new laws, regulations, and decisions affecting employment in federal, state, and local laws. Consult in the development and updates to HR policies and procedures to reflect best practices and legal requirements.
  • Partner with Legal, Compliance, Risk Management, outside counsel, and other departments on investigations, reporting, and policy development. Communicate effectively with internal and external stakeholders, including government agencies and legal partners.

Required skills and qualifications

  • Experience:
    • Significant progressive experience (typically 10+ years) in employment law counseling, employee relations investigations, and compliance.
    • Extensive experience managing and overseeing complex workplace investigations.
    • Demonstrated experience with employment litigation, including developing strategies, managing cases, and working with outside legal counsel.
  • Hard-working and a self-starter with the ability to operate independently with minimal supervision in a fast-paced environment and meet tight deadlines.
  • In-depth knowledge of federal, state, and local employment laws and regulations (e.g., EEO, FLSA, FMLA, ADA, Title VII, Workers Compensation), in all states.
  • Strong negotiation skills and ability to interact with legal and business leaders internally and externally.
  • Proficiency in conducting thorough, impartial investigations, including interviewing, evidence gathering, analysis, report writing, and making sound conclusions.
  • Strong analytical and problem-solving abilities to assess complex situations, identify root causes, and develop appropriate solutions.
  • Sound judgment and empathy with business partners, providing practical, risk-adjusted advice that helps the organization move forward swiftly and thoughtfully.
  • Excellent written and verbal communication skills, including the ability to present complex information clearly and concisely, and to build rapport with diverse stakeholders.
  • Strong leadership and management skills, with the ability to inspire and mentor a team of HR professionals.
  • High level of integrity, accountability, discretion, and the ability to handle confidential and sensitive information appropriately. Strong integrity and commitment to ethics.

Education and Certifications

  • A Juris Doctorate is required.
  • A minimum of 10 years of employment law experience, preferably with some experience at a major law firm and in-house experience at a fast-paced company.
  • Membership and good standing with a U.S. state bar.
